Sales, Shipping & Installation Policies

By purchasing products, requesting services, or entering into any installation, consultation, or delivery arrangement with MONCO LLC, you acknowledge that you have read, understood, and agree to be bound by the following Terms and Policies. These Terms govern all sales, deliveries, installations, and related services provided by MONCO LLC.

FINAL SALE
All product orders are considered final sale. Returns are not permitted except as explicitly authorized by MONCO LLC, and such exceptions are solely at our discretion. Any materials procured by MONCO LLC acting as an agent on your behalf remain your responsibility, and return eligibility cannot be guaranteed.

CUSTOM & SPECIAL-ORDER PRODUCTS
Custom product orders cannot be modified once placed and are not eligible for cancellation or return. Products classified as custom, unfinished, close-out, or clearance are sold as-is and cannot be canceled once ordered. The customer is responsible for verifying that all products are appropriate for the intended application before purchasing.

EXCEPTIONS
If the items you receive are defective, damaged, or incorrect, you must notify MONCO LLC immediately. We will review the issue and determine the appropriate corrective action. The customer is responsible for conducting a final inspection before installation.

CLIENT RESPONSIBILITY
Clients are required to obtain all necessary permits, approvals, and HOA consents and must ensure that the site is safe, accessible, compliant, and free of hazards. MONCO LLC bears no liability for delays, fines, penalties, or costs resulting from client noncompliance. All invoices must be paid according to the terms outlined in these policies. Failure to remit payment authorizes MONCO LLC to suspend work, cancel scheduled services, and pursue liens for unpaid labor, materials, or services. MONCO LLC reserves the right to discontinue services without penalty if jobsite conditions are unsafe or unsuitable. Clients are solely responsible for hidden or unforeseen conditions requiring remediation or additional work.

Clients are solely responsible for confirming the suitability of all selected materials and, by proceeding with a purchase or project, accept the quality, quantity, and specifications of all products—whether procured directly, through a third party, or by MONCO LLC acting as an agent. MONCO LLC disclaims all liability for material defects, delays, or failures. All material selections approved and paid for are final and non-refundable. Any refunds, replacements, or warranty claims for materials are governed exclusively by the policies of the original vendor or manufacturer.

CHANGE ORDERS AND ADDITIONAL WORK
MONCO LLC performs only the labor and services outlined in the approved estimate or invoice. Any changes to the original scope of work require a written and signed Change Order, full payment of additional costs, and acknowledgment of the revised scope. If a client declines necessary changes, MONCO LLC may discontinue services without penalty. The client remains responsible for any incomplete work, materials, or voided warranties resulting from the change in scope.

CANCELLATION, ARBITRATION & GOVERNING LAW
Cancellation: Clients may cancel services without penalty until midnight of the third business day following purchase or signing. Clients remain liable for all costs incurred for materials, labor, and services prior to cancellation.

Arbitration & Governing Law: All disputes arising under these Terms shall be resolved through binding arbitration in the State of Ohio following good-faith negotiation. Arbitration is the exclusive remedy, and both parties waive the right to a jury trial. These Terms are governed by the laws of the State of Ohio.

INVENTORY AND PRICING
Product pricing and availability are subject to change and are not guaranteed until payment and documentation are complete. Manufacturers reserve the right to adjust pricing or availability at any time. Inventory allocation occurs only after full payment is received within 90 days of the received-by date.

DELIVERY LEAD TIMES AND STORAGE
Delivery times are estimates only and not guaranteed. Installation scheduling will not occur until all materials have been received and inspected. Clients are responsible for providing secure, climate-stable storage conditions prior to installation.

SHIPPING REGION
Delivery services are available exclusively within the contiguous United States. Orders placed outside this region will not be accepted or fulfilled.

FULFILLMENT AND PRODUCTION
All flooring and butcher block products are produced in small batches or made-to-order. MONCO LLC prioritizes craftsmanship and material quality over speed; expedited or same-day shipping is not available.

HOME DELIVERY & INSTALLATION READINESS
Clients must ensure that the job site is safe, accessible, and ready for delivery and installation. Delivery includes curbside or threshold placement only unless otherwise arranged. Installation services are scheduled separately once all materials are received and inspected.

INSTALLATION LABOR
Installation labor services are subject to a 25% cancellation fee if terminated after a signed commitment or deposit. MONCO LLC reserves the right to stop work if unsafe or unsuitable conditions exist. Labor warranties do not extend to materials provided by third parties.

WARRANTIES AND LIMITATIONS
MONCO LLC warrants its workmanship against defects for one (1) year from project completion, excluding issues caused by defective materials, moisture, structural movement, accidents, abuse, or improper maintenance. Clients must provide written notice of any workmanship concerns within the warranty period. MONCO LLC’s sole obligation, and the client’s exclusive remedy, is to repair or re-perform defective workmanship at MONCO LLC’s discretion. This warranty replaces all other warranties, express or implied, including merchantability and fitness for a particular purpose. MONCO LLC’s total liability shall not exceed the total contract value paid and does not include incidental, consequential, or punitive damages.

MATERIAL PROCUREMENT
MONCO LLC acts solely as an agent when procuring materials and assumes no liability, warranty, or guarantee for the performance of products. All warranties, returns, and claims are governed exclusively by the manufacturer’s policies. Clients agree that MONCO LLC shall not be held liable for any damages, delays, or costs associated with materials supplied by third-party vendors.

GENERAL PROVISIONS
Indemnification: Clients agree to indemnify and hold harmless MONCO LLC from any claims, damages, or liabilities (including attorney’s fees) resulting from client negligence, willful misconduct, failure to meet obligations, or pre-existing site conditions.

Severability: If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full effect.

Understanding: By engaging MONCO LLC for any product or service, the client acknowledges full understanding and acceptance of these Terms and Policies.

Deposit & Payment: All invoices must be paid in full in accordance with the payment terms listed herein before work commences.

CHARGEBACKS
Filing a chargeback or payment dispute without first contacting MONCO LLC to resolve the matter may result in account suspension or legal action.

HEALTH, SAFETY & LIABILITY DISCLAIMER
All installations are performed in accordance with NWFA (National Wood Flooring Association) and industry standards. However, results can be influenced by conditions beyond our control, including subfloor moisture, HVAC instability, structural movement, or inadequate site preparation. Clients must maintain a safe, accessible, and climate-controlled environment during and after installation. MONCO LLC assumes no liability for issues arising from environmental factors or client negligence.
