By purchasing our products, installation services, or entering into any arrangement with us, you agree to the terms as detailed below in its entirety.



PRODUCT SOLD DIRECTLY BY MONCO LLC

The following policies apply to items we sell that were either manufactured or sold directly by MONCO LLC. Please see "Material Procurement" Section for policies surrounding any third party materials.


DELIVERY, FULFILLMENT & PRODUCTION
Delivery and shipping services are available exclusively within the contiguous United States. Orders placed from or shipping to locations outside this region (including Alaska, Hawaii, and U.S. territories) cannot be accepted or fulfilled at this time.

All products offered by MONCO LLC are produced in small batches or made-to-order. We prioritize craftsmanship, material integrity, and quality control over speed. As a result, expedited, rush, or same-day shipping is not available. Each order is given the time and attention it requires to meet our standards before it leaves our facility. Inventory allocation and production scheduling occur only after full payment is received.

Delivery and production timelines provided by MONCO LLC are good-faith estimates and are not guaranteed. Lead times may be affected by production schedules, raw material availability, and shipping logistics. MONCO LLC will communicate proactively if a significant delay is expected.


PRICING & AVAILABILITY
Product pricing and availability are subject to change without notice and are not guaranteed until full payment has been received and order documentation is complete. MONCO LLC makes every effort to maintain accurate pricing; however, raw material costs and supply conditions may fluctuate.


REFUNDS & RETURNS
Due to the custom nature of the items we sell, all product orders placed are considered final sale. MONCO LLC is not responsible for any stolen/lost packages. Items are not eligible for a refund or cancellation once the order has been confirmed.

Exceptions to this would include defective, damaged (not by freight carrier), or incorrect items received. Please notify us as soon as possible and, if beneficial, include photographs and a written description of the issue should there be an error with your order.


CUSTOM & SPECIAL-ORDER PRODUCTS
Products classified as custom, made-to-order, unfinished, close-out, or clearance are sold as-is and are not eligible for cancellation, modification, or return once the order has been placed and confirmed. Custom orders are produced specifically to your selections and specifications, and production begins promptly upon order confirmation. It is the client's responsibility to verify that all selected products (including species, grade, dimensions, finish, and quantity) are appropriate and accurate for the intended application before finalizing the order.

MONCO LLC is not responsible for client selections that later prove unsuitable for the project.


NO-WARRANTY & CLAIMS PROCESS
MONCO LLC does not offer any product warranty for any products. Any defects or product related issues are handled through our internal claims process. Any response or resolution, if offered at all, is solely up to our discretion/approval and shall act as the only possible route of discourse or resolution.

We do not cover damage caused by improper storage, installation by parties other than MONCO LLC, misuse, neglect, moisture exposure, or failure to follow care and maintenance guidelines.

All claims must be submitted in writing to info@moncollc.com within 90 days of receiving (otherwise deemed accepted & no internal claim can be filed) and all claims must include photographs and a detailed description of the issue. MONCO LLC will evaluate the claim and determine the appropriate remedy at its sole discretion and only if deemed appropriate.

Any warranty coverage provided for products outside of MONCO LLC, if available, is offered solely by the original supplier, manufacturer, or vendor. It is your responsibility to confirm whether a warranty applies and to submit all claims or inquiries directly to that party.



MATERIAL PROCUREMENT

These policies apply when MONCO LLC, acting as an authorized agent on a client’s behalf, sources or purchases materials from third-party manufacturers, vendors, or suppliers in connection with any services we provide.


AGENCY ROLE & LIMITATIONS
When MONCO LLC procures materials on behalf of a client, we act solely as a purchasing agent and do not serve as the manufacturer, distributor, or warrantor of those products. MONCO LLC assumes no liability, warranty, or guarantee for the performance, condition, or longevity of third-party materials. All material selections approved and paid for by the client are considered final and non-refundable through MONCO LLC.


THIRD-PARTY WARRANTIES, RETURNS & CLAIMS
All product warranties, return eligibility, and defect claims for materials procured on the client's behalf are governed exclusively by the original manufacturer's or supplier's policies. Return eligibility for these materials cannot be guaranteed, as third-party return policies vary and are outside of our control. MONCO LLC shall not be held liable for any damages, project delays, or additional costs arising from material defects, backorders, supply shortages, shipping damage in transit, or any other issue attributable to a third-party vendor. Clients are encouraged to review manufacturer warranty documentation for all procured products prior to purchase.


CLIENT RESPONSIBILITY FOR MATERIAL SELECTIONS
The client is solely responsible for confirming the suitability of all selected materials—including species, grade, dimensions, finish, color, and quantity—for the intended application. By approving a material selection and authorizing purchase, the client accepts the quality, quantity, and specifications of all products procured. MONCO LLC disclaims liability for material selections made by the client that later prove unsuitable, incompatible, or insufficient for the project.


PRICING & AVAILABILITY OF PROCURED MATERIALS
Pricing and availability of third-party materials are determined by the original manufacturer or supplier and are subject to change without notice. MONCO LLC will provide the most accurate pricing available at the time of the estimate; however, manufacturers and suppliers reserve the right to adjust costs, discontinue products, or modify availability at any time. In the event of a significant price change after approval but before fulfillment, we will notify you and provide options to proceed or cancel.


LEAD TIMES FOR PROCURED MATERIALS
Delivery timelines for third-party materials are estimates provided by the manufacturer or supplier and are not guaranteed by MONCO LLC. Lead times may be affected by manufacturer production schedules, supply chain conditions, and shipping logistics beyond our control. Installation or project scheduling will not commence until all procured materials have been received and inspected.


DELIVERY, STORAGE & ACCLIMATION OF PROCURED MATERIALS
Clients must ensure that the delivery location is safe, secure, dry, climate-stable and accessible for the arrival of materials purchased that are going to be used in conjunction with our services. Standard delivery includes curbside or threshold placement only, unless an alternative arrangement has been confirmed in writing prior to the delivery date. Interior placement, stair carries, or deliveries requiring special equipment or services are subject to additional fees.

The client is responsible for ensuring that the home and areas delivered meet the acclimation requirements for the specific materials received. Improper storage—including exposure to moisture, direct sunlight, or temperature extremes—may compromise product integrity and void manufacturer warranties. MONCO LLC is not responsible for material damage resulting from improper storage conditions after delivery.


INSPECTION & ACCEPTANCE OF PROCURED MATERIALS
The client is responsible for inspecting all third-party materials upon delivery. Any defects, damage, or discrepancies must be reported to MONCO LLC within forty-eight (48) hours of receipt so that we may coordinate a claim with the original vendor on your behalf. Once materials have been installed, they are considered accepted in their delivered condition, and claims for visible defects or shipping damage will be subject to the manufacturer's policies.



CONTRACTING & SERVICES

These policies apply to all installation, contracting, consultation, and labor services performed or contracted by MONCO LLC.


SCOPE OF WORK
MONCO LLC performs only the labor and services described in the approved estimate, proposal, or invoice. All work is carried out in accordance with NWFA (National Wood Flooring Association) guidelines and recognized industry standards. Any labor, tasks, or services not explicitly included in the approved scope are excluded and will require a separate agreement.


SITE READINESS & CLIENT OBLIGATIONS
Clients are responsible for ensuring that the job site is safe, accessible, code-compliant, and free of hazards at all times. This includes, but is not limited to, obtaining all necessary permits, licenses, approvals, and HOA or community association consents required for the project prior to the start of any work. The work area must be cleared of furniture, personal belongings, and obstructions before the scheduled start date.

Clients must maintain a functioning HVAC system and a climate-controlled environment during and after installation. Recommended environmental conditions typically include a relative humidity range of 30%–50% and a temperature range of 60°F–80°F, though specific requirements may vary by product.

MONCO LLC is not liable for delays, fines, penalties, stop-work orders, or additional costs that result from the client's failure to meet these obligations. Failure to prepare the site may result in rescheduling fees or project delays.


PRE-EXISTING & UNFORESEEN CONDITIONS
Clients are solely responsible for pre-existing, hidden, or unforeseen conditions at the job site—including but not limited to structural deficiencies, moisture issues, mold, asbestos, lead paint, or subfloor irregularities—that may require remediation or additional work beyond the original scope. MONCO LLC reserves the right to discontinue or postpone services without penalty if such conditions are discovered and render the site unsafe or unsuitable for the contracted work.


CHANGE ORDERS & ADDITIONAL WORK
Any modifications to the original scope of work—including additions, substitutions, or reductions—require a written and signed Change Order before the changed work begins. The Change Order must include an acknowledgment of the revised scope, an updated timeline if applicable, and full payment of any additional costs.

If a client declines a change that MONCO LLC determines is required for proper completion, code compliance, or structural integrity, MONCO LLC may discontinue services without penalty or liability. In such cases, the client remains responsible for all costs incurred to date, any materials already procured, and any warranties that may be voided as a result of the incomplete or altered scope.


RIGHT TO STOP WORK
MONCO LLC reserves the right to halt, postpone, or refuse work if unsafe, unsuitable, or non-compliant conditions are identified at the job site. This includes, but is not limited to, inadequate subfloor preparation, uncontrolled moisture levels, lack of functioning HVAC systems, structural concerns, or any condition that compromises the quality or safety of the installation. Work will resume once the identified conditions have been corrected to MONCO LLC's satisfaction.


INSTALLATION SCHEDULING
Installation services are scheduled separately from material delivery and will not be arranged until all project materials have been received, inspected, and properly acclimated according to manufacturer guidelines. Scheduling is subject to crew availability and may be affected by weather, supply delays, or other factors outside our control.


1-YEAR LIMITED WORKMANSHIP WARRANTY
MONCO LLC warrants its workmanship against defects in installation for a period of one (1) year from the date of project completion. This warranty covers labor-related defects only and does not extend to issues caused by defective or unsuitable materials, moisture intrusion, subfloor or structural movement, accidental damage, misuse, neglect, improper maintenance, or failure to maintain proper environmental conditions post-installation.

To make a claim, the client must provide written notice describing the issue to info@moncollc.com within the warranty period, including photographs and a description of the concern. MONCO LLC will evaluate the claim and, at its sole discretion, determine whether the issue falls within the scope of this warranty. If a valid workmanship defect is confirmed, MONCO LLC's sole obligation—and the client's exclusive remedy—is to repair or re-perform the defective work.

This workmanship warranty applies exclusively to labor performed by MONCO LLC. It does not extend to materials provided by third parties, nor does it cover issues resulting from conditions outside of our control. This warranty is provided in lieu of all other warranties related to labor, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.


HEALTH & SAFETY DISCLAIMER
While all installations are performed in accordance with industry standards and best practices, final outcomes can be influenced by variables beyond our control—including subfloor moisture content, HVAC system performance, ambient humidity, structural settling, and the condition of the existing substrate. MONCO LLC assumes no liability for product performance issues, material failure, or aesthetic changes arising from environmental factors, client negligence, or failure to follow post-installation care guidelines.



PAYMENTS, CANCELLATION & BILLING

These policies govern all payment, billing, and cancellation matters. Each policy specifies its applicability based on the product type/classification and whether it relates to services we provide.


PAYMENT TERMS
All product or service invoices, work orders and change orders are due in full in accordance with the terms specified on the estimate, proposal, or invoice. MONCO LLC accepts payment methods as listed at the time of transaction.

For Services & Agent Procured Items: Work will not commence, and agent materials will not be ordered, until all required payments or deposits have been received and cleared. Deposits are non-refundable through MONCO LLC once materials have been ordered or labor has been scheduled. Any concerns, refundability, or returnability of placed material orders should be directed at the entity items were ordered from. If a balance remains unpaid, MONCO LLC reserves the right to assess late fees, suspend active work, withhold deliveries, and pursue all available legal remedies (including the filing of mechanic's liens where permitted by law).


CANCELLATION POLICY
For Services & Agent Procured Items: Clients may cancel services without penalty until midnight of the third (3rd) business day following the date of purchase or contract signing, consistent with applicable consumer protection regulations. Cancellations must be submitted in writing to info@moncollc.com. After the cancellation window has closed, the client remains liable for all costs incurred, including but not limited to materials ordered or received, labor performed, subcontractor fees, restocking charges, and any non-recoverable expenses. Cancellation of installation labor services after a signed commitment or deposit has been received is subject to a twenty-five percent (25%) cancellation fee based on the contracted labor amount.

Items Sold by MONCO LLC: These are not eligible for cancellation once the order has been confirmed, as outlined in the Product Sales section above.


CHARGEBACKS & PAYMENT DISPUTES
**This policy applies to all products and services offered.

MONCO LLC is committed to resolving billing concerns directly and fairly. If you believe there is an error with your invoice or charge, please contact us at info@moncollc.com before initiating a dispute with your financial institution. Filing a chargeback or payment dispute without first making a good-faith effort to resolve the matter directly with MONCO LLC may result in suspension of services, forfeiture of project scheduling, collection action, and recovery of any associated fees or legal costs.




LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, MONCO LLC's total liability for any and all claims arising out of or related to products sold, services performed, or these Terms—whether based in contract, tort, strict liability, or any other legal theory—shall not exceed the total amount paid by the client to MONCO LLC under the applicable order or contract. In no event shall MONCO LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of revenue, loss of property value, or costs of substitute products or services, regardless of whether MONCO LLC has been advised of the possibility of such damages.


DISPUTE RESOLUTION & GOVERNING LAW
MONCO LLC values its client relationships and is committed to resolving concerns promptly and fairly. In the event of a dispute arising from or related to these Terms, both parties agree to first attempt resolution through direct, good-faith communication.

If a resolution cannot be reached informally, the dispute shall be submitted to binding arbitration conducted in the State of Ohio, in accordance with applicable arbitration rules. Arbitration shall be the exclusive method of dispute resolution, and both parties expressly waive the right to a jury trial or participation in a class action. Each party shall bear its own costs and attorney's fees unless the arbitrator determines otherwise. These Terms, and any disputes arising hereunder, shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.


FORCE MAJEURE
MONCO LLC shall not be held liable for any delay or failure to perform its obligations when such delay or failure results from circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, severe weather, pandemics, government actions, supply chain disruptions, material shortages, labor disputes, utility outages, and acts of war or terrorism. In the event of a force majeure occurrence, affected timelines will be extended by a period equal to the duration of the delay, and MONCO LLC will make reasonable efforts to resume performance as soon as practicable.


INDEMNIFICATION
The client agrees to indemnify, defend, and hold harmless MONCO LLC, its owners, employees, agents, and subcontractors from and against any claims, damages, losses, or liabilities—including reasonable attorney's fees—arising from the client's negligence, willful misconduct, misrepresentation, failure to meet obligations under these Terms, or pre-existing site conditions not disclosed to MONCO LLC.


SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or an arbitrator, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.


ENTIRE AGREEMENT
These Terms, together with any signed estimates, proposals, invoices, or Change Orders, constitute the complete and exclusive agreement between MONCO LLC and the client. No verbal representations, promises, or side agreements shall be binding unless confirmed in writing and signed by an authorized representative of MONCO LLC.


AMENDMENTS
MONCO LLC reserves the right to update or modify these Terms at any time. Changes take effect upon posting to our website. Continued use of our products or services after any modification constitutes acceptance of the revised Terms. Clients under active contracts will be notified of material changes that affect their project.


ACKNOWLEDGMENT
By purchasing products, scheduling services, or engaging MONCO LLC in any capacity, the client acknowledges that they have read, understood, and agree to these Terms and Policies in their entirety.



ADDITIONAL POLICIES


INTELLECTUAL PROPERTY
All content on the MONCO LLC website and associated digital platforms—including but not limited to text, images, graphics, logos, product designs, and page layouts—is the exclusive property of MONCO LLC and is protected under applicable intellectual property laws. No content may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of MONCO LLC.


PHOTOGRAPHS & PROJECT DOCUMENTATION
MONCO LLC may photograph or document completed projects for use in marketing, portfolio, social media, and promotional materials. No personally identifiable information, including addresses or client names, will be disclosed without prior written consent. If you prefer that your project not be photographed or used for promotional purposes, please notify us in writing at info@moncollc.com prior to the start of work.


COMMUNICATION & NOTICES
All formal notices, cancellation requests, warranty claims, and written communications required under these Terms must be submitted in writing via email to info@moncollc.com or via U.S. mail to the address listed below. MONCO LLC is not responsible for communications sent to incorrect addresses or through unofficial channels. By providing your contact information, you consent to receive project-related communications from MONCO LLC via phone, email, or text message.


ENVIRONMENTAL & ETHICAL SOURCING
MONCO LLC is committed to responsible sourcing and environmental stewardship. We partner with FSC® (Forest Stewardship Council) and GreenGuard®-certified manufacturers that uphold rigorous environmental and ethical standards across their supply chains.
